DMCA Copyright Policy

Signal Sport respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), Signal Sport will respond expeditiously to claims of copyright infringement committed using our service.

1. Notification of Copyright Infringement

If you believe that content available on or through Signal Sport infringes your copyright, please notify our designated Copyright Agent as described below. Your notice must comply with the requirements of 17 U.S.C. § 512(c)(3) and include the following information:

1.1 Required Information

  1. Identification of the copyrighted work: Identify the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, provide a representative list of such works.
  2. Identification of the infringing material: Identify the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled. Provide sufficient information to allow Signal Sport to locate the material (e.g., URL, username, description).
  3. Contact information: Provide your full name, mailing address, telephone number, and email address.
  4. Good faith statement: Include the following statement: "I have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."
  5. Accuracy statement: Include the following statement: "I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner, or authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed."
  6. Physical or electronic signature: Provide your physical or electronic signature (typing your full name constitutes an electronic signature).

Important: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees. Please ensure your claim is accurate before submitting.

2. Counter-Notification

If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification with our Copyright Agent.

2.1 Required Information

Your counter-notification must comply with 17 U.S.C. § 512(g) and include:

  1. Your physical or electronic signature
  2. Identification of the material: Identify the material that has been removed or disabled and the location at which it appeared before removal or disablement.
  3. Good faith statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number
  5. Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the United States, any judicial district in which Signal Sport may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

2.2 Where to Send Counter-Notice

2.3 Processing Counter-Notifications

Upon receipt of a valid counter-notification, Signal Sport will:

  • Promptly provide the original complainant with a copy of the counter-notification
  • Inform the complainant that Signal Sport will restore the removed material or cease disabling access to it in 10-14 business days
  • Restore the material or cease disabling access to it in 10-14 business days, unless our Copyright Agent receives notice that the original complainant has filed a lawsuit seeking a court order to restrain the subscriber from engaging in infringing activity

3. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Signal Sport has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, accounts of users who are deemed to be repeat infringers.

3.1 Account Termination

Signal Sport may also, at its sole discretion, limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

4. Modifications to Copyrighted Material

Signal Sport reserves the right to remove or disable access to allegedly infringing material without prior notice and without liability to the user who posted such material.

5. No Liability for User Content

Signal Sport does not actively monitor user-generated content for copyright infringement. We act in response to properly submitted DMCA notices. Signal Sport is not liable for any copyright infringement committed by its users.

6. Trademark Policy

While this policy specifically addresses copyright under the DMCA, Signal Sport also respects trademark rights. If you believe that content on our Service infringes your trademark rights, please contact us at legal@signalsports.org with:

  • Identification of the trademark
  • Evidence of trademark registration or common law rights
  • Description of the allegedly infringing use
  • Your contact information
  • A statement that you have a good faith belief the use is not authorized
  • A statement of accuracy under penalty of perjury
  • Your physical or electronic signature

7. Fair Use

Signal Sport respects fair use rights under copyright law. Before submitting a DMCA notice, please consider whether the use of copyrighted material may constitute fair use under 17 U.S.C. § 107. Fair use factors include:

  • The purpose and character of the use (commercial vs. educational/transformative)
  • The nature of the copyrighted work
  • The amount and substantiality of the portion used
  • The effect of the use on the potential market for the copyrighted work

8. False Claims

Submitting a false or fraudulent DMCA notice or counter-notification may result in:

  • Civil liability for damages under 17 U.S.C. § 512(f)
  • Criminal penalties for perjury
  • Liability for costs and attorneys' fees
  • Termination of your Signal Sport account
  • Legal action by Signal Sport or affected parties

9. Copyright Policy for Signal Sport Content

9.1 Our Intellectual Property

All content on the Signal Sport service, including but not limited to text, graphics, logos, icons, images, audio clips, data compilations, and software, is the property of Signal Sport or its content suppliers and is protected by United States and international copyright laws.

9.2 Licensing

Users are granted a limited, non-exclusive, non-transferable license to access and use Signal Sport content for personal, non-commercial purposes only. Any unauthorized use of Signal Sport content may violate copyright, trademark, and other laws.

10. Data and Information Use

The sports odds, analytics, and other data provided by Signal Sport are aggregated from publicly available sources and our proprietary algorithms. Users may not:

  • Reproduce, redistribute, or resell Signal Sport data
  • Use automated systems to scrape or download data
  • Create derivative products from Signal Sport data
  • Remove copyright or proprietary notices from any content

11. User-Generated Content

11.1 User Responsibility

Users are solely responsible for ensuring that any content they post to Signal Sport does not infringe the intellectual property rights of others.

11.2 License Grant

By posting content to Signal Sport, you grant Signal Sport a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with the Service.

12. DMCA Safe Harbor

Signal Sport qualifies for the DMCA safe harbor provisions under 17 U.S.C. § 512. We comply with the notice-and-takedown procedures and maintain a repeat infringer policy as required by law.

13. International Copyright

Signal Sport respects international copyright laws and treaties. Copyright claims from jurisdictions outside the United States should be directed to our Copyright Agent and will be evaluated under applicable international agreements and U.S. law.

14. Processing Time

Signal Sport will process valid DMCA notices and counter-notifications as expeditiously as possible, typically within 2-5 business days of receipt. Complex cases may require additional time for review.
